Qtrainers website is owned and operated by Zexicon Technologies Private Limited; Qtrainers is incorporated under the Indian Laws, having its registered office at 206 Mayuresh Cosmos, Plot No 37, Sector-11, CBD Belapur, Navi Mumbai 400614, as a website as an online marketplace.

Qtrainers may provide terms and guidelines that govern particular features, offers or the operating rules and policies applicable to each Service (for example, events tickets etc.). The User shall be responsible for ensuring compliance with the terms and guidelines or operating rules and policies of Qtrainers. In the event that any of terms, conditions and notices contained in this Agreement or the TOS (Terms of Services) conflict with the additional/other terms and guidelines specified by Qtrainers, then the latter terms/and guidelines shall prevail.

We reserve the right, at our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to you. It is your responsibility to review these Terms of Use periodically for updates/changes. Your continued use of the Website following the posting of changes will mean that you accept and agree to the revisions. As long as you comply with these Terms of Use, we grant you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Website.

Terms and Conditions for Event Organiser

1. The Organiser is required to read and accept all of the terms and conditions laid down in this Terms and Conditions (“Terms” or “Agreement”) and the linked Privacy Policy, before you use the website, content, products and services made available to you by the Qtrainers on the Website.
2. All information accessed or viewed by the Organiser is considered confidential and is for only authorised personal or business purposes.
3. These terms are effective upon acceptance and govern the relationship between the Organiser and Qtrainers and also includes its affiliates and subsidiaries, jointly and severally and also the use of the website. If the Terms conflict with any other document, the Terms will prevail for the purposes of usage of the Website.
4. Accessing, browsing or otherwise using the site indicates your agreement to all the Terms and Conditions under these Terms of use, so please read the terms of use carefully before proceeding. By impliedly or expressly accepting these Terms of Use, you also accept and agree to be bound by Qtrainers policies as amended from time to time.

Communications

When you use the website or send emails or other data, information or communication to us, you agree and understand that you are communicating with us through electronic records and you consent to receive communications via electronic records from us periodically and as and when required. We may communicate with you by email or by such other mode of communication, electronic or otherwise.

Use of the Website

You understand that you are liable for all the Content, in whatever form, that you provide or otherwise make available to or though the Services, including to Users and other users of the Services. You agree not to use the services to:

• Upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libellous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
• Harm minors in any way;
• Impersonate any person or entity, including, but not limited to, the Qtrainers representative or forum leader, or falsely state or otherwise misrepresent your affiliation with a person or entity;
• Upload, post, email, transmit or otherwise make available any content that infringes any patent, trademark, trade secret, copyright or other intellectual property or proprietary rights of any person or entity;
• Upload, post, email, transmit or otherwise make available any content that contain software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or to otherwise interact with the services in a manner not permitted by these Terms or expressly authorised by the Qtrainers.
• Interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the services.
• Intentionally or unintentionally violate any applicable law or regulations; or

Stalk or otherwise harass any person or entity.

• Is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, pedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual;
• You shall not use any robot, spider, or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the website or any content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Website. We reserve our right to bar any such activity and delete the user account without any notice.
• You shall not attempt to gain unauthorised access to any portion or feature of the website, or any other systems or networks connected to the website or to any server, computer, network, or to any of the services offered on or through the website, by hacking, password “mining” or any other illegitimate means.

• You shall not engage in advertising to, or solicitation of, other users of the website to buy or sell any products or services, including, but not limited to, product or services related to that being displayed on the website or related to us. You may not transmit any chain letters or unsolicited commercial or junk email to other Users via the Website. It shall be a violation of these Terms of Use to use any information obtained from the website in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to another person other than us without our prior explicit consent. In order to protect our users from such advertising or solicitation, we reserve the right to restrict the number of messages or emails which a user may send to other users in any 24 hour period which we deems appropriate in its sole discretion. You understand that we have all the rights at all times to disclose any information (including the identity of the persons providing information or materials on the website) as necessary to satisfy any law, regulation or valid governmental request. This may include, without limitation, disclosure of the information in connection with investigation of alleged illegal activity or solicitation of illegal activity or in response to a lawful court order or subpoena. We may disclose personal information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. We may disclose personal information to law enforcement offices, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to: enforce our Terms or Privacy Policy; respond to claims that an advertisement, posting or other content violates the rights of a third party; or protect the rights, property or personal safety of our users or the general public.

PAYMENT METHOD

1. The Qtrainers will collect the amount for the ticketing of the event [“Ticketing Sale Amount”] through its payment gateway and the ticketing sales amount shall be remitted to the Bank Account of the organiser.
2. The Event Organiser shall pay the Qtrainers a total of 7% as commission on the total ticketing sales amount.

1. After the completion of the event and receiving the money from payment gateways, the Qtrainers will check for the bank details of the organiser to remit the amount within 14 working days after deduction of mutually agreed upon commission.
2. You are solely responsible for determining which, if any, sales, use, amusement, value added, consumption, excise and other taxes, duties, levies and charges apply to your use of the services and you agree that it is your sole responsibility to, and that you will, collect, remit and report the correct amounts of all such taxes to the applicable governmental authorities.

Cancellations, Exchanges and Refunds

If you are aware that the details of an event will need to be varied (including time, date, venue, supporting acts etc.) or the event is to be cancelled, you must immediately notify Qtrainers and promptly update the event page.

Tickets once sold cannot be exchanged, cancelled or refunded. Please make sure you check the time and location before you book your tickets. But we would still advise to read the terms and conditions for each event regarding exchange, refund and cancellation.

If an event is cancelled or postponed and the organisers of the event agree on issuing a refund for the tickets, it is up to the organisers to contact you and process the refund.

If an event is cancelled, varied or postponed, you agree to offer to buyers a comparable ticket at a rescheduled event, or a refund of the full ticket price.

Once you have notified Qtrainers about cancellation:

• Qtrainers is holding all payments on your behalf; we will automatically refund the users the full ticket price onto the same payment method from which they have used for buying the event ticket.
• An Event Organiser shall ensure that its refund policy is consistent with the terms and the payment and refund of the website. The website permits an organiser to issue refunds to the users/Company, provided the refund is issued by Organiser with the 5 working days from the end of an event.

Disclaimer of Warranties and Liability

The site and its content are delivered on an “as-is” and “as available” basis. Qtrainers disclaims all warranties, express or implied, including also any implied warranties of merchantability and fitness for a particular purpose.

Qtrainers does not promise that the site will be error-free, uninterrupted, or that it will provide specific results from use of the site or any content, search or link on it. Qtrainers cannot ensure that files you download from the site will be free of viruses or contamination or destructive features.

Qtrainers will not be liable for any damages of any kind arising from the use of this site, including without limitation, direct, indirect, incidental and punitive and consequential damage. Qtrainers makes no guarantee of any specific result from use of this site or use of the Qtrainers service.

In no event shall the Qtrainers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any other damages resulting from:

1. a) the use or the inability to use the services;
2. b) the cost of procurement of substitute goods and services or resulting from any goods, information or services purchased or obtained or messages received or transactions entered through the services;
3. c) unauthorised access to or alteration of the Organiser’s transmissions or data;
4. d) any other matter relating to the services; including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Website.

Neither shall the Qtrainers be responsible for the delay or inability to use the website or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the website, or otherwise arising out of the use of the website, whether based on contract, tort, negligence, strict liability.

Indemnity

You shall indemnify and hold harmless Qtrainers, its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents and employees, from any claim or demand, or actions including reasonable attorneys’ fees, made by any third party or penalty imposed due to or arising out of your breach of this Terms of Use, privacy policy and other policies, or your violation of any law, rules or regulations or the rights (including infringement property rights) of a third party.

Trademark, Copyright and Restriction

This site is controlled and operated by Zexicon Technologies Private Limited and events are sole by respective sellers. All material on this site, including images, illustrations, is protected by copyrights, trademarks, and other intellectual property rights. Material on Website is solely for your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by email or other electronic means and whether directly or indirectly and you must not assist any other person to do so. Without the prior written consent of the owner, modification of the materials, use of the materials on other website or networked computer environment or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks and other proprietary rights, and is prohibited. Any use for which you receive any remuneration, whether in money or otherwise, are a commercial use for the purposes of this clause.

 

Dispute Policy

Generally, transactions are conducted smoothly on Qtrainers. However there may be some cases where both the Buyers and Sellers may face issues. At Qtrainers, we have a Dispute Resolution process in order to resolve disputes between Buyers and Sellers.

What is a dispute?

A ‘Dispute’ can be defined as a disagreement between a Buyer and Seller in connection with a transaction on the Website.

How does dispute occur?

Disputes are filed as a result of a disagreement between the Buyer and Seller. Disputes arise out of an issue that is raised by either party not being completely satisfied with the resolution of their complaint/issue.

It is important that before a Buyer/Seller raises a dispute, they should attempt to solve the issue. Please note that whenever a Buyer raises a dispute, the Sellers’ payment for that order is put on hold immediately until the issue is resolved.

Qmail Abuse & Threat Policy

Private communication, including email correspondence, is not regulated by Qtrainers. Qtrainers encourages its Users to be professional, courteous and respectful when communicating by Qmail (The internal messaging system of Qtrainers).

However, Qtrainers will investigate and can take action on certain type of unwanted qmails that violates Qtrainers policies.

Such instances:

Misuse of Qtrainers system – Qtrainers allows users to facilitate transactions through Qtrainers system, but will investigate any misuse of the services.

Email

Spoof (fake) email on your registered email ID – Qtrainers will never ask you to provide sensitive information through email. In case you receive any spoof (fake) email, you are requested to report the same to us through ‘Contact Us’ tab.
